The National Company Law Appellate Tribunal has granted permission to Bluesky 19 Leasing Company, an aircraft lessee, to inspect the aircraft it had leased to Go First, a company currently undergoing insolvency proceedings. This was the third time a Go First landlord received such an exemption from the appellate body. Engine Lease Finance BV, an engine rental company, and Jackson Square Aviation Ireland, an aircraft rental company, had previously been granted similar rights.
Counsel representing Bluesky 19 Leasing had appealed to the NCLAT to seek clarification on landlords' rights to contest issues other than inspection. However, the court rejected the appeal, stating that its earlier decision in the ELFBV case had already provided clear indications in this regard.
